Bayer CropScience has filed another US lawsuit against Dow AgroSciences over alleged patent infringement involving herbicide tolerance in genetically modified crops. A US court has ruled that fipronil-based insecticides marketed by Makhteshim Agan North America (MANA) and its affiliate, Control Solutions, do not infringe BASF or Bayer CropScience patents. The US District Court for the Middle District of North Carolina granted a motion for summary judgement this month. BASF and Bayer filed a lawsuit against MANA and Control Solutions in April 2010 over “imminent infringement” of patents relating to the manufacture of fipronil (Agrow No 589, p 2).
